The Site allows you to request a concrete floor-coating estimate and to learn about our products and services. We may connect you with our installation team or with participating installers, contractors, or service providers (“Service Providers”) to fulfill your request.

Any agreement, transaction, pricing, warranty, or work is governed by the separate written estimate or contract you receive. We do not guarantee that a Service Provider will contact you, provide an estimate, perform work, or meet your expectations through the Site alone.

4. Consent to Be Contacted

By submitting your information through the Site, you agree that Comer & Cross and/or its partners and Service Providers may contact you about your request and related offers, including by phone call, text message (SMS), email, automatic telephone dialing systems, prerecorded or artificial voice messages, and other means, at the phone number and email address you provide, even if that number is on a state or federal Do-Not-Call list.

Consent is not a condition of purchasing any goods or services. Message and data rates may apply. You may opt out of text messages by replying STOP, opt out of emails using the unsubscribe link, and request to stop marketing calls as described in our Privacy Policy.

To the fullest extent permitted by law, Comer & Cross and its affiliates, officers, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, even if advised of the possibility of such damages. Our total liability for any claim arising from your use of the Site will not exceed one hundred U.S. dollars ($100).

11. Indemnification

You agree to indemnify and hold harmless Comer & Cross and its affiliates and partners from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or your violation of these Terms.

12. Dispute Resolution and Arbitration

Please read this section carefully. To the extent permitted by law, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court. You and Comer & Cross waive the right to a jury trial and the right to participate in a class action. You may opt out of this arbitration provision by contacting us within 30 days of first accepting these Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Subject to the arbitration provision above, the exclusive venue for any dispute will be the state or federal courts located in Michigan.

14. Changes and Severability

We may modify, suspend, or discontinue the Site or these Terms at any time. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
